Liability For Stabbings At Van Nuys High Schools

Crime is unfortunately all to common at schools across the nation. According to the National Center for Education Statistics, “During the 2019–20 school year, 77 percent of public schools recorded that one or more incidents of crime had taken place, amounting to 1.4 million incidents. This translates to a rate of 29 incidents per 1,000 students enrolled in 2019–20.” Much of the crime that takes place is never properly reported or documented. There are many steps schools should take in order to prevent outbursts of violence.

  • Schools should have an appropriate level of security. Certain schools in high crime areas will need greater security measures than schools in other areas.
  • Schools should intervene to prevent fights from escalating into violence.
  • Schools should promote peaceful conflict resolution between students.

Schools have a legal responsibility to create a reasonably safe environment for students. They must enforce all rules and regulations necessary for their protection. Students must also be protected from reasonably foreseeable acts of violence – even if the attack comes from a third party outside of the school. When a school fails to adequately supervise children who are injured by strangers on school grounds, this could form the basis of a negligence claim.

Consider, for example, Leger v. Stockton Unified School Dist. (1988) 202 Cal. App. 3d 1448. A California Court of Appeal held that a school can be held liable for an attack where a female student was assaulted by a non-student in the school restroom. The school knew of other similar attacks and therefore knew that the restroom in question was unsafe. Despite this, they failed to take appropriate action to protect minor students. It was determined that the assault took place due to the school’s failure to supervise. It is important that evidence is properly preserved after any school assault.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • School records related to the incident and similar incidents should be examined.

It can  be hard to know what to do after any instance of violence at school. Violence can disrupt a child’s ability to learn and feel safe. Victims are often left with long-term psychological trauma. Any person that is injured in an attack at school may have legal recourse through a personal injury claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
