Liability For Hayward Police Shootings

Far too many people are killed or seriously injured every year in police shootings. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” Many more people are seriously injured following police encounters. There are a number of measures that police departments should take in order to help prevent police shootings.

  • Police officers should be trained to de-escalate encounters.
  • Police officers should be trained to use less lethal measures when possible.
  • Police officers should request for backup in high risk situations.

A police department could be liable for a shooting if one of their officers used excessive force.  According to California Penal Code 835a. (1), the authority to use physical force by police officers is a serious responsibility and shall be used judiciously with respect to human dignity and sanctity of human life. All people in California have the right to be free of excessive force that is carried out under the color of law. Victims of police shootings tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Death

Whether or not a police officer’s use of force was reasonable will depend on their actions leading up to a shooting. Many police shootings involve officers that fail to follow department policies. The family of any person that died in a police shooting may be able to seek some measure of justice through a constitutional claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
