Marsy’s Law Attorneys

Marsy Law

For victims who have been harmed by a crime, the process of seeking justice can feel overwhelming and intimidating. Victims must contend with a variety of demands from several parties, including prosecutors, defense attorneys, and judges. All of this is taking place as victims are still trying to cope with the physical and emotional repercussions of what happened.

This is why Marsy’s Law is so important. It gives crime victims clear rights under the law that are embedded into California’s constitution. These rights must be respected at all parts in the legal process and are treated in equal measure to the rights of the accused party.

What is Marsy’s Law?

Marsy’s Law, which is also called the Victims’ Bill of Rights, is a constitutional amendment adopted in many different states that provides crime victims with a set of comprehensive rights. In California, Marsy’s Law provides a number of guarantees.

  • Victims must be treated with fairness and integrity throughout the entirety of the criminal justice process.
  • Victims must be reasonably protected from the actions of the defendant and others who may be acting on their behalf.
  • Victims must be informed of all public proceedings related to the defendant. This will include trials, plea hearings, sentencing, and parole hearings.
  • Victims have a right to be heard at every crucial stage of the criminal justice process.
  • Victims have a right to receive restitution for any losses that they suffered as a result of a crime.
  • Victims have a right to have their safety and privacy be taken into consideration when courts are making bail and release decisions.

These rights are an integral part of California’s constitution. Law enforcement, courts, and prosecutors must enforce and protect these rights at all times.

A Gap in the Legal Process

Crime victims often assume that prosecutors are acting entirely on their behalf. But this is a major misconception. Prosecutors are employed to represent the interests of the public, not the particular interests of a crime victim. The job of the defense attorney is to protect the rights of the defendant. The role of a judge is to oversee criminal proceedings and act with impartiality. This leaves a major gap in the legal process. There is no single person whose sole role is to protect the rights of victims and advocate on their behalf–unless a person chooses to retain an attorney.

Why It Is Important to Have a Marsy’s Law Attorney

A Marsy’s Law attorney steps into the role of advocating for victims. They do more than just explain your rights to you as your assailant is being prosecuted. They will enforce them. At the Carrillo Law Firm, our attorneys will fight hard to ensure that your rights are protected.

  • We will provide you with timely notice of all hearings and major developments throughout the case.
  • We will ensure that your right to attend any proceedings is protected.
  • We will provide you with meaningful opportunities to speak up during every portion of the criminal justice process, including plea negotiations, sentencing, and release decisions.
  • We will fight to ensure that you receive the maximum restitution in every instance where this is permitted.

Having an experienced Marsy’s Law attorney advocate on your behalf can make it far more likely that your rights and interests are honored. Whether you would like to make a victim impact statement or object to procedural issues, you have a right to be heard. There is a tremendous peace of mind in knowing that someone is advocating on your behalf.
