WHITTIER, CALIFORNIA (October 19, 2026) – At least 13 students at Katherine Edwards Middle School were injured after a large tree branch fell on top of them in Whittier.
Whittier police officials are saying that the incident occurred around 2:05 PM at the middle school located on the 6800 Block of Norwalk Boulevard. Firefighters and paramedics received reports that a large tree branch fell on top of the students during periods of high winds.
First responders arrived at the location and began tending to the injured victims. A full investigation into the cause of the accident remains ongoing at this time.
Liability for Accidents Involving Falling Tree Branches
Schools in California have a legal obligation to maintain their premises in a reasonably safe condition and protect students from reasonably foreseeable sources of harm. Pursuant to CA Govt Code § 835, “a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred.” Courts will take into consideration several factors when evaluating liability for any accident involving a falling tree on school grounds.
- Tree Condition: Courts will consider the condition of the tree and whether or not there are visible cracks or decay that could indicate it is structurally unstable.
- Inspection History: Courts will review the inspection history of the tree to determine whether or not it has been identified as being dangerous.
- Prior Complaints: Courts will also review any complaints that the school received about branch failures or other incidents related to the tree.
- Protective Measures: Courts will consider what protective measures school officials took to prevent accidents involving fallen trees.
When a school fails to take reasonable measures to protect students from falling tree branches, this could serve as evidence of negligence. One case that illustrates this very well is Toeppe v. City of San Diego. A woman suffered serious injuries after being hit by a large branch that fell from a eucalyptus tree in a public park. Attorneys for the plaintiff argued that the tree was negligently maintained, which created a dangerous condition. The court ultimately reversed a judgment that was held in favor of the city.
How to Protect Students From Falling Tree Branches on School Grounds
Accidents involving falling trees and falling tree branches may seem like freak occurrences, but they actually are much more common than many people realize. According to one estimate by the National Weather Service, there were 32 recorded deaths and another 42 injuries involving falling trees during high wind conditions in 2024 alone. What follows are some of the measures that schools and businesses can take to protect pedestrians from falling trees.
- Routine Maintenance: Schools should routinely inspect and maintain the trees on their property.
- Tree Removal: Schools should remove trees that have dying branches or other signs of major disease.
- Restricted Areas: Schools should section off areas that have a high likelihood of people being hit by falling branches.
- Safe Placement: Schools should avoid putting tables or playgrounds in areas where students may be susceptible to getting hit by a falling tree.
It could be difficult to know where to begin after any accident involving a falling tree branch. Victims often sustain very serious injuries that require lengthy rehabilitation periods. This is especially true if any person is hit in the head by a falling tree branch. Schools across California have demonstrated time and again that they’re not likely to accept responsibility after any accident involving a falling tree on their property. This is why it’s so important that these incidents are thoroughly investigated by a third party.
