IRVINE, CALIFORNIA (July 22, 2026) – A 20-year-old Irvine man has tragically died in a police shooting by the intersection of Sungate and Silkwood.
Irvine Police Department officials are saying that the incident occurred around 11:45 AM on Tuesday. A man reportedly called the Irvine police and told them that he was experiencing some type of mental health crisis outside of his home.
Officers spoke with him for over an hour and encouraged him to surrender peacefully. Authorities allege that the man charged them while holding a knife.
Officers opened fire and struck the man. They began life-saving measures which were taken over by paramedics. The unidentified man was transported to the hospital in critical condition.
Unfortunately, he was later pronounced dead at the hospital.
Liability for Irvine Police Shootings
A police officer’s ability to use lethal force should only be used as an absolute measure of last resort. According to California Penal Code § 835a(a)(1), “the authority to use physical force, conferred on peace officers by this section, is a serious responsibility that shall be exercised judiciously and with respect for human rights and dignity and for the sanctity of every human life. The Legislature further finds and declares that every person has a right to be free from excessive use of force by officers acting under color of law.” Police officers should take certain actions if they encounter someone who they believe may be in the midst of a mental health crisis.
- Distance: Officers should keep a safe distance and avoid rushing in.
- Slow Down: Officers should do their best to slow down the encounter so that they are able to properly assess the person’s mental and emotional condition.
- De-escalation: Officers should use de-escalation techniques and use alternatives to force before resorting to using their firearms whenever possible.
- Crisis Intervention: Officers should request assistance from a crisis intervention team.
Officers are expected to follow all protocols and procedures related to dealing with any person who may be in the midst of a mental health crisis. And officers’ failure to follow a safety rule propagated by the employer could serve as evidence of negligence. One of the most common mistakes that officers make in these types of encounters is to rush in quickly and shout multiple commands at the same time. This can substantially make the situation worse and increase the odds that any encounter will end in a police shooting.
Collecting Evidence After A Police Shooting
A disproportionately large portion of police shootings involve people who were suffering from an acute mental health crisis. According to one report by the Vera Institute of Justice, “Maine’s Attorney General reported that between 2000 and 2012, 42 percent of people shot by police, and 58 percent of those who subsequently died, had a mental health diagnosis. A Washington Post analysis showed that one quarter of fatal police shootings in 2015 involved a person who was mentally unstable.” It’s important that evidence is properly preserved and collected after any police shooting.
- Prior Encounters: It matters whether or not the police officers who responded to the scene had prior knowledge or prior encounters with the victim.
- Body Camera Footage: All body camera footage from officers involved should be carefully reviewed.
- Medical Records: Medical records and autopsy reports are also important pieces of information.
- Eyewitnesses: Information gathered from eyewitnesses could also be important. They can help provide context related to what happened and leading up to the shooting.
Courts in California will consider the totality of circumstances leading up to any shooting to determine whether excessive force was used. Even if a police shooting seemed justified in the moment, it may not have been. Sadly, police departments are not likely to accept any responsibility when their officers make mistakes and use excessive force.
