Sacramento County officials are saying that the school district contacted Folsom police after an incident at Folsom Middle School. Police said that they discovered “multiple counts of lewd acts with a child under 14 years old, oral copulation with a person under 14 years old, and kidnapping.”

Gary Jimenez Jr worked at Folsom Middle School and Oak Chan Elementary School. He has since been arrested and charged with numerous counts of child sexual abuse.

He is currently being held at the Sacramento County Main Jail on numerous felony charges. A full investigation into the actions of Gary Jimenez Jr remains ongoing at this time.

Liability For Sacramento County Child Sexual Abuse

Sexual abuse is very common in K – 12 education. Children with special needs tend to be particularly at risk. According to the Vera Institute of Justice, “Children with disabilities are three times more likely than children without them to be victims of sexual abuse, and the likelihood is even higher for children with intellectual or mental health disabilities. These children face many challenges in reporting the abuse and receiving vital services designed to meet their needs.” There are many steps that schools should take in order to reduce instances of child sexual abuse.

  • Schools should thoroughly vet all teachers and employees.
  • Schools should have clear guidelines relating to sexual misconduct.
  • Schools should thoroughly investigate and report all suspected instances of sexual abuse.

All schools have a legal obligation to properly supervise the students in their care and take measures to protect them. This includes protecting them from sexual abuse at the hands of teachers and other school faculty. As outlined in Virginia G. v. ABC Unified School District (1993) 15 Cal.App.4th 1848, schools can also be liable for the sexual assault of a student if teachers knew (or should have known) about that teacher’s history of sexual abuse and failed to act. Many steps should be taken after any suspected instance of child sexual abuse.

  • A police report of the incident should be created.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The disciplinary record of the teacher involved should be reviewed.
  • An experienced sexual abuse attorney should be contacted.

By the time any teacher is arrested for child sexual abuse, there were likely dozens of red flags that were missed. Part of the problem in these cases is that suspected instances of abuse are never properly reported or investigated. Schools may also fail to properly vet the teachers that they hire. The parent of any child that is sexually abused at school may be able to seek some measure of justice through a civil claim. A teacher sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
