San Bernardino County officials are saying that the incident took place just before 5:00 p.m. on March 9. Police received reports about a teen who was allegedly fighting with family members and damaging property.
When the police arrived they encountered Ryan Gainer who was allegedly holding some type of gardening tool. Officers claim that the teenager approached them with the gardening tool before they opened fire.
Paramedics were called to the scene in order to help the boy. Ryan Gainer was taken to the hospital where he was later pronounced dead.
An investigation into the use of force remains ongoing at this time.
Liability For Apple Valley Police Shootings
California has one of the highest instances of fatal police shootings. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” There are a number of steps that police departments should take in order to avoid harming suspects.
- Police officers should be well-trained in de-escalation techniques.
- Police officers should follow a use of force continuum and only use lethal force as a measure of last resort.
- Police officers should be trained to follow department protocols for dealing with mentally ill suspects.
A police department could be liable for a police shooting if their officers used excessive force. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. Officers have specific guidelines for when they must interact with mentally ill suspects. If an officer believes that a suspect may be in the midst of a mental health crisis, there are several steps that they should follow.
- Request backup
- Calm the situation
- Avoid physical contact
- Determine if the suspect is taking medication
- Acknowledge the suspect’s feelings
- Not make any threats
Police shootings are much more likely to take place when officers are poorly trained. In far too many situations, officers make certain encounters more dangerous by threatening suspects early on and not following de-escalation techniques. It is important that victims of police brutality understand that they do have rights. The family of any person who died in a police shooting may be able to seek some measure of justice through a constitutional claim.
