Liability For San Bernardino County Child Abuse

Abuse and mistreatment within the K–12 education system are sadly all too common. According to the California Department of Education, “school safety is often compromised. According to a 2019 survey, nearly half (44%) of U.S. high school students had one or more violent experiences in the previous year, such as bullying, physical fighting, being threatened with a weapon at school, dating violence, or sexual violence.” There are a number of measures that schools should take in order to prevent students from becoming victims of abuse.

  • Schools should develop and enforce clear policies for appropriate behavior between school officials and students.
  • Schools should train teachers and stuff on recognizing, preventing, and reporting abuse.
  • Schools should do everything within reason to create and foster a safe environment.
  • Schools should perform background checks on all prospective employees.

Depending on the facts of any case, a school could be liable if a teacher abuses a student. Schools have a legal obligation to protect children in their care. To that end, schools must enforce all rules and regulations necessary for the protection of students. Teachers are also mandated reporters and must report all reasonably suspected instances of child abuse. If a school failed to take reasonable measures to protect a child from being abused by a teacher, this could form the basis of a negligence claim. It is important that certain steps are taken after any instance of teacher abuse.

  • Eyewitnesses should be interviewed.
  • A police report of the incident should be created.
  • Medical records related to the abuse should be preserved.
  • An experienced child abuse attorney should be contacted.

Abuse within any school is rarely an isolated incident. By the time any teacher or school employee is arrested for abuse, there are likely many red flags that were missed. Sadly, though, schools will often do everything within their power to avoid responsibility if a student is injured in their care. Any person who is abused at school may be able to seek some measure of justice through a civil claim. A child abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
