Liability For Los Angeles County Inmate Sexual Assaults

Sexual abuse among the inmate population in California remains alarmingly common. According to USA Today, “Sexual victimization of adult inmates is an ongoing problem in U.S. jails and prisons, with thousands of victims of inmate-on inmate abuse and staff-on-inmate abuse during 2016 through 2018, according to a special report by the U.S. Department of Justice released Tuesday.” Preventing sexual abuse in jails requires a multidisciplinary approach.

  • Jails should ensure that inmates and correctional officers are properly supervised.
  • Jails should thoroughly vet all of the law enforcement agents that watch inmates.
  • Jail should have clear and comprehensive guidelines relating to sexual misconduct.

It is illegal for any correctional officer to have a sexual relationship with an inmate under California Penal Code 289.6 (a). This includes consensual relationships that would have been legal had they taken place outside of the prison system. The power dynamic between correctional officers and inmates is too great for any type of meaningful consent. When a jail fails to protect an inmate from sexual abuse, they can be held accountable through a constitutional claim. Victims of sexual abuse often suffer from a wide variety of injuries.

  • Sexually transmitted infections
  • Anxiety
  • Depression
  • Post traumatic stress disorder

The vast majority of abuse cases in prisons are highly preventable. They are much more likely to take place when officials turn a blind eye to reasonably suspected instances of abuse. By the time any correctional officer is arrested for sexual misconduct, there were often dozens of red flags that were missed. Any person that is sexually abused while in-custody may have legal recourse through a civil claim. An inmate sexual abuse lawyer can examine all of the unique facts of your case and let you know what your legal options are.
