Liability For Los Angeles Police Department Car Accidents

Car accidents involving emergency vehicles are sadly much more common than many people may realize. According to the National Safety Council, “In 2021, 198 people died in crashes involving emergency vehicles. The majority of these deaths were occupants of non-emergency vehicles (56%). Deaths among pedestrians accounted for another 25%, while emergency vehicle drivers represented 15% and emergency vehicle passengers accounted for about 3% of the deaths.” There are a number of factors that could contribute to a car accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Poor road conditions

When a police officer is responding to an emergency, they will typically have immunity in the event that they are involved in a collision. But their lights and sirens must have been on. When a police officer is not responding to an emergency, they must obey the rules of the road like every other driver. If a police officer fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any collision with a police vehicle.

  • Surveillance footage should be sought.
  • Medical records should be reviewed.
  • Footage from the police vehicle should be preserved.
  • Eye witnesses should be interviewed.

The vast majority of pedestrian accidents are preventable. They tend to involve drivers that are distracted or speeding. It is important for accident victims to remember that they do have rights. The family of any person that died in a police accident may have legal recourse through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
