Liability For Hacienda Heights Police Shootings

Police shootings in LA County are much more common than many people may realize. According to the Los Angeles Times, “LAPD officers shot 27 people, killing seven, in all of 2020, and shot 26 people, killing 12, in 2019, The Times reported. Officers shot 33 people in 2018. The 26 shootings in 2019 marked a 30-year low in the number of LAPD shootings in a given year, and a dramatic drop in such shootings from a high of more than 100 per year in the early 1990s.” There are a number of steps that police departments should take in order to prevent police shootings.

  • Police officers should be well trained in de-escalation techniques.
  • Police officers should be required to wear body cameras when they are interacting with the public.
  • Police officers should have less lethal alternatives to their firearm.

Police officers should always use lethal force as a measure of last resort when all other options have been exhausted. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. The circumstances of any police shooting should be well understood.

  • Body camera footage from all officers involved should be sought.
  • Eye witnesses should be interviewed.
  • It should be known if the officers had previous interactions with the suspect.
  • Medical records related to the shooting should be preserved.

People suffering from a mental health crisis are nearly 16 times more likely to be killed in a police shooting than the general public. This is one of the reasons it is so important that police officers are properly trained. Any person that is injured due to the excessive force of police officers may have legal recourse through a civil claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
