Liability for Los Angeles County Coach Sexual Abuse
Sexual abuse involving school coaches remains very common. According to a new report by the Guardian, “in some cases, coaches and instructors have exploited children’s vulnerabilities and the physical contact sport enables in order to groom and abuse them.” It has been estimated that nearly 20% of all sexual perpetrators at schools are coaches. There are several factors that could contribute to sexual abuse in a school setting.
- Inadequate background checks on teachers and volunteers can allow predators to infiltrate the school system.
- Schools may lack clear policies with respect to monitoring students.
- School officials may fail to report warning signs of misconduct or dismiss allegations against teachers or coaches.
- Schools may fail to set clear boundaries with respect to appropriate behavior.
School districts have a legal obligation to protect students from reasonably foreseeable sources of harm. This includes protecting them from sexual abuse and other forms of misconduct by teachers and coaches. Teachers and school officials are mandated reporters and must report any reasonably suspected instance of sexual abuse. A mandated reporter who fails to report any incident of reasonably suspected child abuse or neglect is guilty of a misdemeanor under California Penal Code 11166(c). When school officials have actual or constructive notice that a teacher poses a risk of harm to students, they must take action. It is important that certain steps are taken after any instance of child sexual abuse involving school teachers.
- A police report of the abuse should be created.
- Medical records related to the abuse should be collected.
- The history of misconduct involving the perpetrator should be understood.
- The actions of school officials related to the perpetrator should be scrutinized.
- An experienced teacher sexual abuse attorney should be contacted.
Sexual abuse in a school setting is often highly preventable. It tends to happen at schools that failed to implement safeguarding procedures. Teachers may be allowed to spend extended periods of time alone with students. Schools may fail to identify concerning behavior, such as grooming. Victims of teacher sexual abuse are protected by a number of laws. They are able to seek some measure of accountability through a civil claim.
