Any person with more information about the actions of Fernando Barreto-Hernandez should reach out to the Glendale Police Department. A full investigation remains ongoing at this time.

Liability for Glendale Delivery Driver Sexual Assault

Sexual assaults involving gig workers such as delivery drivers remain very common. According to one report by NBC News, “Uber reported 141 incidents of rape and 998 incidents of sexual assault overall in 2020, even as the business was crippled by the ramifications of the Covid-19 pandemic and ridership plummeted, according the company’s 2019-2020 U.S. Safety Report released Thursday.” They are also facing several lawsuits for claims related to sexual abuse. Delivery companies should take a number of measures in order to prevent abuse.

  • Delivery companies should ensure that all of their drivers undergo thorough background checks.
  • Delivery companies should establish and enforce clear policies related to misconduct.
  • Delivery companies should create better response systems to address complaints.

Delivery companies have a legal obligation to protect people from reasonably foreseeable sources of harm. This includes sexual abuse and misconduct. Depending on the facts of any case, a delivery company could be liable for the sexual abuse of a person by a driver. Many of the sexual abuse claims against delivery companies are based on the legal theory that the perpetrator was negligently hired or retained. There are several elements that must be demonstrated in this type of claim.

  • The worker was unfit for their job or posed an unreasonable danger to clients.
  • The worker’s employer knew or should have known about the danger that the worker posed.
  • The unfit nature of the worker caused harm to the victim.
  • The worker’s negligent hiring or retention was a substantial factor in causing the harm.

The vast majority of sexual assaults by workers are preventable. They tend not to occur in isolation. Indeed, by the time any worker is arrested for sexual abuse, there were likely numerous missed red flags. Part of the problem is that many gig companies choose to perform background checks that aren’t as thorough as they could be. Any person that is sexually assaulted by a delivery worker may be able to seek some measure of accountability through a civil claim.
