Liability for Los Angeles County Industrial Accidents
Despite many decades of improvements in workplace safety standards, workers are routinely exposed to unsafe conditions that result in serious injury and death. According to the National Safety Council, “The number of preventable work deaths decreased 3% in 2023, totaling 4,543. In addition to preventable fatal work injuries, 740 homicides and suicides occurred in the workplace in 2023. These intentional injuries are not included in the preventable-injury estimates.” Companies should take a number of measures to prevent industrial accidents.
- Risk Assessment: Companies should perform routine audits and site inspections to uncover potential hazards.
- Training: All workers should receive training about staying safe, especially in industrial settings. Workers should be trained in proper lockout/tagout procedures when working with heavy equipment.
- Personal Protective Equipment (PPE): Workers should be equipped with all of the PPE that they need to stay safe. This includes hard hats and fall equipment.
When a worker is injured or killed in the state of California, they will typically have legal recourse through a workers’ compensation claim. Workers compensation operates on a no-fault insurance scheme. There is no need for an injured worker to demonstrate that one or more parties was negligent to receive benefits. In addition to workers compensation, injured workers and their families may also have recourse through a third-party liability claim.
A third-party liability claim may be possible when an entity separate from a worker’s employer contributed to an accident. There are many different sources of third-party negligence after any industrial accident. This includes the company that manufactured a piece of industrial equipment. If one of these machines lacked key safety features like security latches, the manufacturer could be held at fault through a product liability claim. It is essential that evidence be properly preserved after any accident.
- The condition of the property where the accident took place should be properly documented.
- Medical records related to injuries should be preserved.
- Surveillance footage that may have captured the incident should be sought.
- The condition of any equipment involved in the accident should be investigated.
A large portion of workplace accidents are totally preventable. They tend to involve situations where OSHA regulations are not being followed. This usually includes instances where workers are not provided adequate training. It is important that workers and their families understand that they do have legal options. They are able to seek some measure of justice through a civil claim.
