SCOTUS Decision Praised by Safety Advocates for Allowing Trucking Brokers to Be Held Liable for Negligence

WASHINGTON, D.C. (June 1, 2026) – The US Supreme Court issued a unanimous ruling that allowed a man injured in a truck accident to proceed with his lawsuit against a freight broker.
That case focused on a man identified as Shawn Montgomery. He was in a parked vehicle that was struck from behind by a speeding semi-truck.
That crash left him seriously injured. C.H. Robinson was identified as the freight broker who hired the truck that struck him.
They argued in court that they were shielded from state law liability claims. However, the court did not side with their argument.
Instead, the justices held that the claim in question fell within a motor-vehicle safety exception. This has placed increased pressure on brokers that operate within California and across the United States.

Liability for Accidents Involving Freight Brokers
Truck companies have a legal obligation to protect other roadway users from reasonably foreseeable sources of harm. This includes exercising some amount of care to ensure that any truck company hired for a particular trip is well qualified and otherwise safe. What would constitute reasonable care on behalf of a truck broker will continue to be litigated in the courtroom. At the same time, though, freight brokers will likely adhere to stricter safety standards.
