Liability For Los Angeles County Police Shootings

Many people are seriously injured or killed in police shootings every year. According to Johns Hopkins Bloomberg School of Public Health, “A new study from researchers at the Johns Hopkins Center for Gun Violence Solutions and Vanderbilt University found that an average of 1,769 people were injured annually in police shootings from 2015 to 2020, 55 percent of them or 979 people, fatally.” A number of different issues could contribute to a police shooting.

  • Police officers may make poor decisions under stress.
  • Police officers may fail to use de-escalation techniques.
  • Police shootings are more likely to take place when suspects are suffering from an untreated mental illness.

Police officers must always use the least amount of force necessary for any given encounter. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. There are a number of different ways that an officer may have used excessive force.

  • Police officers may have shot a suspect who has already surrendered.
  • Police officers may have shot a suspect who did not pose a threat to anyone.
  • Police officers may have failed to follow department protocol.

Whether or not a police officer’s action could be considered excessive will depend in part on the officer’s actions leading up to the encounter. If an officer failed to follow a safety rule promulgated by their employer, this could serve as evidence of negligence.
