Salvador Fabian, Former Del Oro High School Coach in Bakersfield, Arraigned After Being Arrested on Sex Crime Charges

BAKERSFIELD, CALIFORNIA (November 29, 2025) – A former walk-on band coach at Del Oro High School in Bakersfield, identified as Salvador Fabian, has been arraigned on child sex crime charges.
Kern County officials are saying that the defendant was first arrested on October 28. Police officers were called to the high school after getting reports of a suspect having an inappropriate relationship with a student.
Kern County high school district officials are saying that Salvador Fabian is no longer an employee at the high school. Authorities issued a criminal protective order against the defendant, barring him from having any type of contact with the alleged victim.
Salvador Fabian is scheduled to make another court appearance on December 8. His bail has been set at 245,000.
A full investigation into all of the charges remains ongoing at this time.
Liability for Kern County School Sexual Abuse
Schools in California have a legal obligation to protect students from foreseeable sources of harm. This includes protecting them from sexual abuse at the hands of teachers and coaches. Consider, for example, C.A. v. William S. Hart Union High School Dist., a school district “may be liable through respondeat superior for the negligence of other employees who were responsible for hiring, supervising, training, or retaining [the perpetrator].” There are many steps that schools should take to prevent instances of child sexual abuse.
- Vetting: Schools should ensure that all employees undergo rigorous background checks.
- Monitoring: Schools should carefully monitor students at all points of the day and enforce all rules necessary for the protection of those students.
- Safeguards: Schools should implement policies that prevent teachers and other employees from being isolated with individual students.
If a school has actual or constructive notice that a teacher or coach poses a risk of harm to students, the school must take action. Failing to take action in the situation could constitute the basis of a negligence claim. In far too many situations, schools will be aware that there are complaints against a certain teacher or coach. But they will fail to properly investigate and go through all of the necessary safety protocols.
Steps to Take After Sexual Abuse Involving School Employees
Sexual abuse at high schools across California and the United States remains a much more common problem than many people realize. According to one study featured in Sage Journals, “Educator sexual misconduct is a serious problem in the United States (U.S.), with a 2004 Department of Education report estimating that 9.6% of K-12 students in the U.S. had experienced either verbal, visual, or physical educator misconduct at some point during their school career.” A number of measures should be taken after any instance of sexual abuse in school.
- Police: The misconduct should be reported to the police so that they can begin an official investigation. This will also help prevent the perpetrator from harming additional victims.
- Evidence Preservation: All evidence related to misconduct should be carefully collected and preserved. This may include text messages and physical items like clothing.
- Medical Evaluation: Victims should seek a thorough medical evaluation to address any physical or psychological injuries that they have sustained as a result of the misconduct.
- Legal Support: Any person sexually abused by a school employee should seek the guidance of a school sexual abuse attorney. An attorney can help preserve key pieces of evidence and make sure that your rights are being protected.
Sexual abuse in a school setting is often highly preventable. These incidents tend to happen when safety measures are not being followed. By the time any school employee is arrested for sexual abuse, there were often many red flags that were missed. Part of the problem is that school employees are afraid that they may be subject to retaliation if they speak up against certain instances of misconduct. The victims of sexual abuse are able to seek some measure of justice and accountability through a civil claim.
