Michael Davis, High School Math Teacher at Learning Choice Academy in San Diego, Accused of Sexual Relationship With 17-Year-Old Female Student

SAN DIEGO, CALIFORNIA (April 21, 2025) – A teacher at the Learning Choice Academy in San Diego, identified as Michael Davis, was arrested for an alleged sexual relationship with a minor student.
San Diego County officials are saying that the relationship lasted from February through March of 2025. Michael Davis has since been charged with 12 felony counts, including contacting a minor with the intent of having sexual intercourse.
His bail was initially set at $200,000, but it was lowered to $50,000. Michael Davis has since been bonded out of jail and was ordered not to contact the alleged victim.
A full investigation into all of the allegations remains ongoing at this time.
Liability for Sexual Abuse Involving School Teachers
Sexual misconduct involving school teachers remains a very common occurrence. According to one study in Sage Journals, “Educator sexual misconduct is a serious problem in the United States (U.S.), with a 2004 Department of Education report estimating that 9.6% of K-12 students in the U.S. had experienced either verbal, visual, or physical educator misconduct at some point during their school career.” Schools should take many different measures in order to protect students from sexual misconduct.
- Training: Teachers should be trained to understand what is and is not acceptable in a school setting with respect to students.
- Guidelines: Schools should develop and enforce strict guidelines with respect to sexual misconduct.
- Background Checks: Schools should ensure that all of their teachers and other employees undergo thorough background checks.
Schools have a legal obligation to protect students from reasonably foreseeable sources of harm. They must enforce all rules and regulations necessary to protect students from sexual misconduct and other criminal activity. One of the best safeguarding methods is to simply prevent individual teachers from being isolated with individual students. If a school is aware that a teacher has a history of misconduct or is otherwise a danger to children, they must take action.
School districts and their employees have a special relationship with their students, which imposes certain duties to protect those students from harm. Consider, for example, C.A. v. William S. Hart Union High School District (2012). In that case, a student was allegedly sexually abused by Roselyn Hubbell, who served as a guidance counselor. According to the court, “Because school personnel were in a special relationship with plaintiff, they owed him a duty of taking reasonable care to prevent the abuse by Hubbell.” It is important that certain actions are taken after any instance of sexual abuse in a school setting.
- The history of misconduct involving the teacher should be understood.
- Medical records related to the incident should be preserved.
- A police report of the incident should be created.

Much of the sexual abuse that takes place is preventable. There are often red flags that certain teachers may pose a risk to students. But these red flags may be ignored.
