Liability For Loma Linda Police Shootings

Police shootings remain all too common across California. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” Police officers should take a number of measures in order to avoid police shootings.

  • Request backup
  • Calm the situation
  • Avoid physical contact
  • Determine if the suspect is taking medication
  • Acknowledge the suspect’s feelings
  • Not make any threats

The ability to use lethal force is one of the most consequential powers that officers hold. It should always be a measure of last resort. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. Officers have specific guidelines for when they must interact with mentally ill suspects. When officers fail to follow safety rules from their department, this could form the basis of a civil claim. It is important that certain steps are taken after any police shooting.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Body-camera footage from all officers involved should be reviewed.
  • The actions of police officers leading up to the shooting should be understood.

Police shootings are often highly preventable. They tend to involve officers that are either unwilling or unable to de-escalate encounters. Sadly, though, police departments will often do everything in their power to deny responsibility when their officers kill someone. It is important that victims of police brutality understand that they do have rights. The family of any person that died in a police shooting may have legal recourse through a civil claim.
