Liability for Los Angeles County Child Sexual Abuse

Sexual abuse involving teachers and other educators is very common in Los Angeles County and across the United States. According to Psychology Today, “Charol Shakeshaft thoroughly reviewed the existing research literature available at the time detailing sexual misconduct in school settings. In her subsequent report to the USDOE, known colloquially as the “Shakeshaft Report,” she estimated the prevalence of educator sexual misconduct at the time to be 9.6 percent of the U.S. student body.” There are a number of factors that can contribute to abuse.

  • Teachers with a history of abuse or misconduct are more likely to engage in future abuse.
  • Poor oversight on behalf of schools or other organizations can contribute to abuse.
  • Students with intellectual or physical disabilities are statistically more likely to become victims of sexual abuse.

Depending on the facts of any case, there could be numerous sources of liability for any incident where a child is sexually abused. Of course, the assailant could be held responsible, both through a criminal and civil claim. But any organization that hired the abuser in some official capacity could also be held at fault. Schools have a legal obligation to properly vet all workers. They must take reasonable measures in order to prevent students from being sexually abused. It is important that certain steps are taken after any instance of child sexual abuse.

  • A police report should be created.
  • Eyewitnesses should be interviewed.
  • An experienced teacher sexual abuse attorney should be contacted.

Sexual abuse is often highly preventable. Much of the abuse that takes place occurs when students are allowed to be isolated with the abusers. Students are often too ashamed to speak up, which is what may allow abuse to continue uninterrupted for many years. Sadly, though, schools and other organizations will often do everything in their power to deny responsibility if a child in their care is abused. This is why it is so important for abuse victims to seek legal support as early as possible.
