Liability for Long Beach School Sexual Abuse
Schools across Los Angeles and California have faced a flood of sexual abuse claims in recent years. According to Cal Matters, “In April, Los Angeles County paid $4 billion to settle 6,800 abuse claims from victims who were abused in foster care or in probation department facilities. Like many government entities, Los Angeles County is self-insured.” These lawsuits are the result of years of poor decisions and a total failure to safeguard the well-being of children.
- Grooming: Studies have found that the vast majority of sexual abuse in school settings began as grooming. Sadly, school officials have often failed to see the signs that their children are being groomed.
- Institutional Failures: In many instances, schools were made aware that certain teachers were engaging in misconduct or problematic behavior. But these reports were dismissed or not properly investigated.
- Prevention Measures: Schools in Los Angeles County and elsewhere would often lack standardized protocols for reporting or responding to abuse. Teachers were often allowed to be isolated with individual students, thereby putting them at risk.
Schools in California have a duty of care to protect students from foreseeable sources of harm. This includes protecting them from the criminal conduct of teachers or other third parties when that misconduct becomes foreseeable. If a teacher or school official has actual or constructive notice that a school employee poses a risk of harm to students, they must take action. Failing to take action to protect against a known risk of harm could form the basis of a negligence claim.
To prevent abuse, schools must enforce all rules and regulations necessary to keep children safe. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” A school could be liable for the abuse of children off campus if it occurred during an officially sanctioned school event like a field trip. There are many ways that an attorney can help after any instance of sexual abuse at school.
- Investigation: A child sexual abuse attorney can investigate all of the circumstances surrounding any instance of abuse. They can determine if the perpetrator had prior complaints or allegations against them.
- Legal Protection: An attorney can help survivors remain anonymous when possible by using Jane/John Doe filings.
- Navigating Laws: An attorney can identify all liable parties and use evidence of institutional cover-up to strengthen a claim.
- Compensation: An attorney can help abuse victims seek compensation for all of the damages that they’ve suffered. This includes emotional distress, medical treatments, and loss of educational opportunities.
Sexual abuse is one of the most destructive and harmful experiences that a child can go through. It can have far-reaching implications for their physical and psychological well-being. Among other things, survivors are at a greater risk of developing anxiety, depression, and PTSD. Unfortunately, schools will virtually never accept responsibility if one of their teachers harms a student. This is where an attorney can be incredibly helpful. They can evaluate all of the unique facts of any case free of cost and let you know what your legal options are.
