Liability for Oak Hills Child Sexual Abuse
Sexual abuse in a school setting remains all too common. According to one study between the years 2017-2018, there were “[fourteen] thousand one hundred fifty-two allegations of sexual assault (0.02 percent of all school children at the time; defined as threatened rape, fondling, indecent liberties, or child molestation).” There are a number of patterns that help define school sexual abuse.
- Most of the perpetrators are teachers (63.4%).
- The vast majority of perpetrators are male.
- Girls are much more likely to be the victims of sexual misconduct.
- Abuse is often followed by grooming behaviors, which may include giving gifts and special attention to victims.
Schools have a legal obligation to take reasonable measures in order to protect students from foreseeable sources of harm. Sexual misconduct involving teachers is a known hazard. When a school fails to enforce rules necessary for the safety and protection of students, this could form the basis of a civil claim. Consider, for example, Kimberly M. v. Los Angeles Unified School Dist. (1989). The California Court of Appeals held, “since a teacher is entrusted with great authority, a school district might be vicariously liable for a sexual molestation perpetrated by its teacher in a classroom against a five-year-old student.” It is important that certain steps are taken after any instance of sexual abuse in a school setting.
- A police report of the incident should be conducted.
- Medical records related to any assault should be preserved.
- The scope of the abuse that took place should be understood.
- An experienced child sexual abuse attorney should be contacted.
Sexual abuse is one of the most harmful things that most children will ever go through in their lives. It can leave them with lifelong physical and psychological injuries. Abuse victims often report experiencing anxiety, depression, and post-traumatic stress disorder. Survivors are also much more likely to experience suicidal ideations throughout the course of their lives. Any person that is impacted by sexual abuse in a California school may be able to seek some measure of accountability through a civil claim.
