$275,000.00 Verdict – B.H. v. Lake Elsinore USD

This case involved a child who was bullied and then beaten up in March 2016 at Lakeland Village School in the Lake Elsinore Unified School District. The incident, which was captured on camera, showed a bigger girl sucker punch the middle school student who was sitting at a lunch table having lunch with her friends. After getting sucker punched, the minor plaintiff was thrown on the ground where the bully continued to punch her until another child stepped in to stop the fight. The minor plaintiff suffered a concussion as a result of the attack.

The firm argued that the school district was negligent in the way that failed to protect the child. The school knew about these “repeat offenders” who would constantly cause problems on campus for the plaintiff and yet the school failed to intervene to prevent future bullying. What made it worse is that the deans at the school told the bullies that the plaintiff had made a complaint that ignited an already bad problem of bullying for the child.

The minor plaintiff had to deal with substantial issues since the school attack. She had to undergo therapy for her anxiety and also had to deal with post concussive headaches.

After a trial on the case in Riverside County Superior Court, the jury found in favor of the minor plaintiff.
