Liability For Napa County Sexual Abuse
Sexual abuse in the K-12 education system is sadly far more common than many people may realize. According to the National Education Association, “there were 14,938 incidents of sexual violence in K–12 schools in 2017 – 2018 compared with 9,649 in 2015 – 2016, representing a 55 percent increase. These include incidents of rape or attempted rape and sexual assault.” Schools are supposed to take a number of measures in order to protect students from sexual abuse.
- All school employees should receive a thorough background check.
- School employees should have comprehensive training that outlines appropriate and inappropriate conduct.
- Schools should establish clear codes of conduct.
- Schools should create a confidential reporting system for students.
School districts have a legal responsibility to protect students from forseeable sources of harm. This includes protecting students from sexual abuse and other forms of misconduct. As outlined in Virginia G. v. ABC Unified School District (1993) 15 Cal.App.4th 1848, schools can also be liable for the sexual assault of a student if teachers knew (or should have known) about that teacher’s history of sexual abuse and failed to act. Several steps should be taken after any instance of teacher sexual abuse.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- A police report should be created.
- An experienced teacher sexual abuse attorney should be contacted.
By the time any school employee is arrested for sexual abuse, there were likely dozens of red flags that were missed. Teachers are supposed to report all reasonably suspected instances of child abuse. But far too often, abuse goes unreported and overlooked. It is important that victims of sexual abuse understand that they do have rights. any person that was sexually abused by a teacher may be able to seek some measure of justice through a civil claim.
