Liability for Los Angeles County Police Shootings
Liability for any police shooting will typically hinge on whether or not a police officer’s pre-shooting decisions and use of force were reasonable given the totality of circumstances leading up to the shooting. Generally speaking, police officers are required to use the least amount of force necessary for any given encounter. They must only escalate their use of force as is reasonably necessary given the situation. There are a number of factors that must be considered when determining whether or not police officers may have used excessive force.
- It matters whether or not deputies had a lawful basis to detain, confront, or escalate an encounter with a suspect.
- It matters whether or not a suspect posed an immediate threat of death or serious bodily harm to officers or the general public.
- It matters whether or not officers gave their commands or warnings before using lethal force.
- It matters whether or not officers attempted to de-escalate the encounter before resorting to deadly force.
Deadly force should only be used as an absolute measure of last resort. A police department can be liable if one of their officers used excessive force and shot a suspect. Police officers should be particularly cautious when they’re dealing with a person who may be in the midst of a mental health crisis. If police officers failed to follow a safety rule promulgated by their employer, this could serve as evidence of misconduct.
Steps To Take After Los Angeles Police Shootings
Many people are seriously injured or killed every year during encounters with law enforcement. According to the Public Policy Institute of California, “About 195 people die each year from interactions with California law enforcement. Gunshots are by far the most common cause of death: nearly 250 people are shot by police each year.” Certain actions should be taken after any police shooting in Los Angeles County.
- Medical Records: All the medical records associated with the person’s treatment should be collected and preserved.
- Body Cameras: Any body camera footage that captured the incident should also be sought.
- Officer Misconduct: It should be determined if the officers involved have been the subject of misconduct complaints.
- Legal Review: Victims of police brutality should seek an independent review of the shooting with the team experienced in constitutional law and civil rights claims.
Police shootings are often highly preventable when officers are following safety protocols. Unfortunately, police departments will almost never accept responsibility when one of their officers seriously injures or kills a suspect. When these departments investigate themselves, they will nearly always come to the conclusion their officers did nothing wrong. This is why it’s so important that victims of police brutality seek an independent investigation.
