HIGHLAND PARK, CALIFORNIA (October 1, 2026) – A student has tragically died at Benjamin Franklin High School in Highland Park after falling for undetermined reasons.

Los Angeles County officials are saying that the incident occurred around 1 PM on Wednesday. Witnesses reported hearing a student fall in the quad of the high school.

Apparently, the student fell from the fourth floor of one of the buildings. First responders were called to the scene of the incident, which also prompted a lockdown.

Despite life-saving measures, the student unfortunately died due to the severe nature of their injuries. Very few details about what led up to the incident have been released.

But one witness reported that the teen fell after some kind of dispute with another student. A full investigation remains ongoing at this time.

Liability for Student Injuries and Deaths on School Properties

California schools have a legal obligation to use reasonable care to supervise students and protect them from foreseeable sources of harm while they’re on school grounds. This duty requires that teachers and other faculty monitor the behavior of students and use reasonable intervention when any type of dangerous conduct is taking place. Under California Government Code section 815.2, a school district could potentially be liable for the negligent actions of one of its employees who was operating within the course and scope of their job duties.

  • They will consider whether staff are able to observe all assigned areas throughout the school and respond quickly to any fight or threat.
  • They will consider the actions of school officials regarding any reported incidents related to bullying.
  • They will review witness statements and surveillance recordings that show whether or not reasonable intervention took place.
  • They will assess the training materials that teachers and other faculty had access to.

When a school fails to adequately supervise students who are then harmed on school grounds, this could be construed as negligence. Consider, for example, Dailey v. Los Angeles Unified School District, 2 Cal.3d 741 (1970). In that case, two students were participating in slap boxing when one of the students fell backward and fractured their skull. That student later died. Attorneys for the plaintiff argued that school officials were negligent for failing to supervise the students and to intervene as necessary.

Preventing Bullying and Violence at Los Angeles Schools

Unfortunately, violence and bullying remain a common problem across Los Angeles County and throughout the United States. According to one report by the Centers for Disease Control, roughly 8% of U.S. high school students reported being in a physical fight on school property at some time over the last 12 months. Schools should adopt a number of practical measures to prevent these types of incidents.

  • Reporting: Schools should give all students clear and accessible ways to report any instances of violence, threats, or bullying that they encounter.
  • Supervision: Students should be supervised at all times while they’re on school grounds.
  • De-escalation: Schools should train teachers and other employees in de-escalation techniques.
  • Protocols: Schools should establish clear protocols and procedures for responding to any fight or threat of violence.

Instances of harm at schools across California tend to be highly preventable. They often involve numerous safety lapses when it comes to properly monitoring the students. Any type of safety review of an injury or death at school should examine the written policies of the school and how those policies are put into practice on a day-to-day basis. The family of any child who died in a school setting is able to seek some measure of accountability through a wrongful death claim.
