A full investigation into the allegations remains ongoing at this time.
Liability For Orange County Student Sexual Abuse
Student sexual abuse is unfortunately very common in California. Los Angeles County, in particular, has been plagued by allegations and numerous sexual abuse lawsuits. According to Fox LA, “A $24 million settlement was reached on behalf of three women who alleged they were sexually abused by their elementary school teacher in 2006 and 2007, their attorney announced Wednesday. The plaintiffs, identified only as Jane Does 1, 2, and 3, had filed separate lawsuits in Los Angeles and Van Nuys Superior Courts in 2021.” Schools should take several steps in order to protect students from sexual abuse.
- Schools should conduct thorough background checks on all employees.
- Schools should develop and enforce codes of conduct with respect to sexual harassment and abuse.
- Schools should investigate all allegations of misconduct.
Schools have a legal obligation to protect students from sexual misconduct. They must properly supervise students at all times of the day that students are in their. Officials must also enforce all rules and regulations necessary for their protection. In particular, teachers must report all reasonably suspected instances of abuse. When school officials fail to protect students from abuse, this could form the basis of a civil claim. A school may have made a number of mistakes that contributed to sexual abuse.
- Schools may have failed to investigate allegations of misconduct.
- Schools may have allowed teachers to be isolated with individual students.
- Schools may have allowed a teacher who posed a risk to students to keep teaching.
It is crucial that schools take a holistic approach when it comes to keeping children safe from sexual abuse. Teachers should feel free to report misconduct. But in far too many situations, teachers and other school employees are reluctant to report abuse because they feel as though they could face repercussions. It is important for victims of abuse to understand that they do have rights. Any person who is sexually abused by a teacher may have legal recourse through a civil claim.
