LOS ANGELES, CALIFORNIA (July 12, 2023) – A 29-year-old teacher identified as Martin Reyes Jr was arrested on child sex abuse charges in Los Angeles County.

The LAPD is saying that the arrest took place after they executed a search warrant. Martin Reyes Jr was arrested on suspicion of committing lewd acts with a child under 14.

A representative for the LAPD declined to name the school that the defendant worked for. He is currently being held on a $1 million bail.

Detectives believe that Martin Reyes Jr is responsible for additional sexual assaults that have not yet been reported. Any person that may have more information is encouraged to contact Crime Stoppers.

A full investigation remains ongoing at this time.

Liability For Los Angeles County Teacher Sexual Abuse

Parents entrust schools and teachers to nurture and care for their children. But far too often this trust is violated in the most horrific ways possible. Part of the problem is that many people in positions of power are ignoring red flags. According to Redlands Daily Facts, “School administrators, teachers and staff in California are required by law to alert authorities to suspicions about sexual abuse of underage students. But in school districts across Southern California, some educators are shirking that duty, choosing to keep things quiet rather than “ruin lives” of co-workers and suffer the taint of bad publicity.” There are a number of signs that a child may be a victim of sexual abuse at school.

  • A child may begin having recurring nightmares.
  • A child may develop eating disorders.
  • A child may develop a strong aversion to being touched.
  • A child might start having panic attacks.

It is a crime for an adult to have a sexual relationship with a minor. It is well-established in law that children are not capable of consenting to sexual activity. Pursuant to California Penal Code 288, it is a crime for a person to commit any lewd or lascivious act on a child under 16 years of age. This includes touching a child’s body for sexual purposes. The touching does not need to be on bare skin. A school district could face liability for sexual misconduct involving their teachers.

Schools must properly supervise their students. Consider, for example, C.A. v. L.A. Unified School District. The Court of Appeal held, “Ineffective supervision of a student, as well as the failure to use reasonable measures to protect a student from foreseeable injury from a third party, may constitute a lack of ordinary care on the part of those responsible for student supervision.” There are a number of steps that should be taken after any instance of child sexual abuse.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Disciplinary records for the accused teacher should be examined.
  • An experienced teachers sexual abuse attorney should be consulted.

By the time a teacher is arrested for sexual abuse, there were likely dozens of red flags that a school missed that should have disqualified them. Any person that is sexually abused by a teacher in Los Angeles County may be able to seek some measure of accountability through a civil claim. A Los Angeles County teacher sexual abuse attorney can examine the unique facts of your case and let you know what your legal options are.
