Liability for Los Angeles Police Shootings
Police departments have a legal obligation to use reasonable amounts of force for any given encounter. When a police officer uses excessive force, this could form the basis of a constitutional claim. Pursuant to 42 U.S. Code § 1983, every person who, under the color of any statute, law or ordinance, causes a citizen of the United States to be deprived of their rights secured by the constitution, shall be liable to the injured party in an action at law. Courts in California will consider several measures when determining whether or not any specific officer’s use of force was reasonable.
- Circumstances: Courts will take into consideration the totality of circumstances that an officer was facing at the time of the incident.
- Crime: Courts will take into consideration the severity of the suspected crime that the victim was being accused of.
- Threat: Courts will take into consideration whether or not officers attempted to de-escalate the encounter.
- Mental Health: Courts will consider whether or not officers followed safety rules promulgated by their employer related to suspects who may be in the midst of a mental health crisis.
It is important to consider what officers were doing in the lead-up to any encounter prior to the shooting. Even if an officer’s actions seemed reasonable in the moment, they may not have been when considering the totality of circumstances an officer was facing. Far too many police shootings involved officers who are either unwilling or unable to de-escalate encounters. When assessing liability, it matters whether or not responding officers received adequate training.
Steps to Take After Los Angeles Police Shootings
Police shootings and law enforcement uses of force remain quite common across California and the United States. According to the Law Enforcement Epidemiology Project, “In the U.S. during a given year, an estimated 1 million civilians experience police threat of or use of force resulting in a conservative estimate of 75,000 non-fatal injuries requiring hospital treatment and 600-1100 deaths.” Certain steps should be taken after any person dies in police custody.
- Any history of misconduct related to the officers involved should be studied.
- All medical records related to the incident should be reviewed.
- Body camera footage from responding officers should be scrutinized.
- The family of any person who died in a police shooting should seek an independent investigation by a team experienced in constitutional law.
It can be difficult to know where to begin after any police shooting. These incidents can leave victims with devastating injuries. Many people do not survive. Unfortunately, police departments will almost never accept responsibility if one of their officers uses excessive force. The family of any person who died in a police shooting is able to seek some measure of accountability through a civil claim.
