Liability For Riverside County Child Sexual Abuse

Child sexual abuse is far more common than many people realize. In fact, many instances of abuse are never even reported. According to the Centers for Disease Control, “About 1 in 4 girls and 1 in 13 boys in the United States experience child sexual abuse. Someone known and trusted by the child or child’s family members, perpetrates 91% of child sexual abuse.” There are a number of signs that parents should look for which could indicate child sexual abuse.

  • Children who are sexually abused might experience recurring nightmares.
  • Children who are sexually abused  are more prone to anxiety and panic disorders.
  • Children who are sexually abused may develop an aversion to being hugged or touched.
  • Children who are sexually abused may do everything they can to avoid certain people or places.

Pursuant to California Penal Code 288, it is a crime for a person to commit any lewd or lascivious act on a child under 16 years of age. This includes touching a child’s body for sexual purposes. The touching does not need to be on the bare skin of the child. According to California Penal Code 647.6, it is a crime for an adult to behave in any sexual way with a minor.

In addition to criminal charges, a daycare could be held liable for the sexual abuse of a child carried out by one of its employees. Day cares have a legal obligation to provide children with a reasonably safe environment. When a daycare fails to take the necessary steps to protect children from sexual abuse, this could form the basis of a negligence claim. There are a number of steps that should be taken after any instance of suspected sexual abuse at a daycare.

  • A police report should be created.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.
