Khimberly Zavaleta Died in Suspected Attack at Reseda Charter High School in Los Angeles

Khimberly Zavaleta, 12, Died After Being Hit By Metal Water Bottle While Defending Her Sister From Alleged Bullying Incident at Reseda Charter High School

LOS ANGELES, CALIFORNIA (March 2, 2026) – A 12-year-old girl identified as Khimberly Zavaleta has tragically died after being hit by a metal water bottle at Reseda Charter High School in Los Angeles.

Los Angeles County officials are saying that the incident took place on February 17. Authorities believe that Khimberly Zavaleta was hit by the metal water bottle while she was defending her sister from an alleged bullying incident.

Paramedics were called to the scene of the attack to help the victim. Khimberly Zavaleta sustained a traumatic brain injury and was taken to UCLA Mattel Children’s Hospital to receive treatment.

Despite life-saving measures at the hospital, her heart gave out and she was later pronounced dead. The incident is currently being investigated as a homicide.

A full investigation into the attack remains ongoing at this time.

Liability for Los Angeles County School Attacks

Schools have a legal obligation to protect all of the students in their care from reasonably foreseeable sources of harm. This includes protecting them from criminal attacks. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” There are several steps that schools should take to protect students from assaults by other students.

  • Bullying: Schools should establish anti-bullying and anti-violence policies and strictly enforce those policies.
  • Monitoring: Schools should increase adult supervision in high-risk areas. This includes on the playground and in hallways.
  • Reporting: Schools should implement anonymous reporting systems that can help uncover bullying.
  • Training: Teachers should be trained to reduce potential conflicts through de-escalation techniques and peer mediation.

If school officials failed to properly supervise a student who was attacked on school grounds, this could form the basis of a negligence claim. These types of incidents are virtually never random. They tend to be the result of an escalating series of conflicts. Unfortunately, school officials routinely fail to address safety concerns when students were facing known hazards.

  • Medical Records: All medical records related to any incident should be collected and preserved.
  • Surveillance Footage: Any surveillance footage that may have captured the incident should also be sought.
  • School Records: The history of interactions between the students involved should be understood.
  • Legal Review: The family of the students injured should seek the legal guidance of a team experienced in negligence claims.
