Liability For Fontana Coach Sexual Abuse

Sexual abuse at the hands of coaches is actually much more common than many people may realize. According to one report by the U.S. Department of Education, around 10% of students experience sexual misconduct by teachers during their K-12 school experience. Not every offender may be a teacher. They could also be a coach, counselor, janitor or principal. Coaches often use the physical contact that sport enables to abuse their students. There are many steps that schools should take in order to prevent sexual abuse.

  • Schools should thoroughly vet all teachers and school employees.
  • Schools should always properly monitor the students in their care.
  • Schools should have clear guidelines on appropriate conduct between teachers and coaches and their students.
  • Schools should thoroughly investigate all suspected instances of sexual misconduct.

All schools have a legal obligation to protect their students from reasonably foreseeable sources of harm. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” When a school fails to properly monitor students who are then abused, this could form the basis of a negligence claim. It is important that evidence is properly preserved after any instance of sexual abuse.

  • A police report should be created.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • It should be understood if the teacher involved faced prior disciplinary actions.

It is common for teachers who abuse students to have a long history of misconduct. They often have multiple victims across multiple school districts. In many situations,  school officials have suspicions about what was going on, but they never took any concrete actions. The family of any child that is sexually abused at school may have legal recourse through a civil claim. A teacher sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
