Liability for Los Angeles County Child Sexual Abuse
Sexual abuse involving school teachers remains very common in schools across California and the US. According to neaToday, “there were 14,938 incidents of sexual violence in K–12 schools in 2017 – 2018 compared with 9,649 in 2015 – 2016, representing a 55 increase.” Girls are substantially more likely to become the victims of sexual misconduct. Much of the sexual abuse that takes place in a school setting is preventable. There are a number of safety lapses that could contribute to school sexual abuse.
- Schools may fail to conduct background checks on all of their staff and volunteers.
- Schools may have ignored red flags that arose during past employment.
- Schools may have allowed students to be secluded with teachers in unmonitored areas.
- School policies may discourage reporting misconduct.
Schools have a legal obligation to protect students from foreseeable sources of harm. Sexual abuse by teachers, coaches, and other staff is a known hazard. Schools must properly monitor students at all times of the school day and during officially sanctioned events in order to prevent abuse. As outlined in Virginia G. v. ABC Unified School District (1993) 15 Cal.App.4th 1848, schools can also be liable for the sexual assault of a student if teachers knew (or should have known) about that teacher’s history of sexual abuse. It is important that certain steps are taken after any instance of sexual misconduct involving a school teacher.
- Any medical records related to the incident should be collected.
- A police report of the incident should be created.
- The actions of school officials to prevent sexual misconduct should be understood.
- An experienced teacher sexual abuse attorney should be contacted.
Sexual abuse can be one of the most harmful and destructive experiences that children can go through. Survivors are at risk of a whole host of negative outcomes. Many suffer long-term psychological trauma, including post-traumatic stress disorder, anxiety, and depression. They are also at greater risk of self-harm and developing a substance-use disorder. Any person that is sexually abused in a Los Angeles County school may be able to seek some measure of accountability through a civil claim.
