Liability for Sexual Abuse Involving Police Departments
Police departments have a legal obligation to protect any children in their custody from reasonably foreseeable sources of harm. This includes protecting them from sexual abuse and other forms of misconduct involving their officers. A police department could potentially be liable for any instance of sexual abuse committed by their officers, if the perpetrator was negligently hired or retained. There are typically several elements that will need to be demonstrated in any retention case.
- The worker was hired, retained, or supervised by the employer.
- The employee exhibited traits or conduct that showed they were unfit for their job or posed a foreseeable risk.
- The employer knew or should have known that the worker was unfit for their position.
- The employer’s negligent hiring or retention was the proximate cause of the victim’s injuries.
If a police department had actual or constructive notice that one of their officers posed a risk of harm and failed to act, this could form the basis of a negligence claim. What matters in these cases is foreseeability. Previous complaints of misconduct make it foreseeable that additional offenses may occur in the future. By the time any police officer is arrested for abuse or other crimes, there were often numerous red flags that were missed.
Steps to Take After Sexual Abuse Involving Police Officers
Sexual abuse involving law enforcement remains quite common. According to CBS News, “research from Bowling Green State University [reveals that] police officers in the US were charged with forcible rape 405 times between 2005 and 2013. That’s an average of 45 a year. Forcible fondling was more common, with 636 instances.” It is important that several actions are taken after any police officer is accused of abuse in the course of their job duties.
- Any complaints against the police officer should be collected and reviewed.
- Eyewitnesses that may have more information about any alleged misconduct should be interviewed.
- The police should be alerted to the misconduct as soon as possible so that they can begin an official investigation.
- The victims should consider their legal options with a team that has experience pursuing sexual abuse claims.
Police officers have a great deal of authority and respect is conferred upon them. Unfortunately, this authority is often abused. Children are particularly vulnerable to abuse in cases of police misconduct because they are consistently taught to obey adults and other authority figures. Victims of misconduct by law enforcement are protected by a number of laws. They are able to seek some measure of accountability through a civil action.
