Liability for Sexual Assaults Involving Riverside County Firefighters

When a firefighter or other government employee is accused of sexual assault, there could be several sources of liability for the abuse. Employers in California have a legal obligation to prevent reasonably foreseeable sources of harm. This necessitates that the people they employ are actually competent and reasonably safe. Among other things, they should not have violent criminal records. The employer that a firefighter worked for could be liable for sexual assault through a negligent hiring claim. There are several elements that must be demonstrated in such a claim.

  • The defendant employed the individual that caused harm to the plaintiff.
  • The employee that caused the harm was unfit or posed a foreseeable risk of harm in their job capacity.
  • The employer knew or should have known that their employee posed a risk of harm to others.
  • The employer failed to use reasonable care when selecting or screening the employee.
  • The employee’s unfit nature was the proximate cause of the plaintiff’s injury.

Sexual abuse involving government employees is often highly preventable. By the time any firefighter or police officer is arrested for sexual abuse, there are often numerous red flags that were missed. These red flags can manifest in a variety of different ways. An employee may have had multiple complaints of misconduct against them. A number of people accused of sexual violence have a long history of inappropriate touching or making inappropriate comments.

Steps to Take After Sexual Assaults Involving Riverside County Firefighters

A number of government workers have been accused of sexual assault. Many of these incidents involve police officers. According to research from Bowling Green State University, police officers across the United States were charged with rape a total of 405 times between the years of 2005 and 2013. Another 605 officers were charged with forcible touching. Several steps should be taken after any instance of sexual assault involving a firefighter or other government employee.

  • The assault should be reported to the police as early as possible so that they can begin investigating.
  • All of the medical evidence related to the assault should be collected and preserved. This evidence can be crucial in proving what happened.
  • It should be determined if there may be additional victims. It’s also important to learn whether or not the assailant was the subject of other complaints.
  • Victims should seek the legal guidance of a team experienced in sexual assault claims.

Sexual assaults can be among the most traumatic and harmful experiences that most people will ever go through. It is vital that victims understand that they do have legal rights. They are able to seek some measure of accountability and justice through a civil action. Damages through a civil claim can help cover lost wages, medical bills, and pain and suffering.
