SANTA ANA, CALIFORNIA (November 17, 2024) – A 37-year-old choir teacher at Santa Ana High School identified as Yessenia Garcia was arrested on suspicion of having a sexual relationship with a student.
Orange County officers were called to Santa Ana High School around 6:00 p.m. on Friday. A 17-year-old male student told police that he had been having a sexual relationship with Yessenia Garcia for around six months.
The defendant worked at the school for around five years. Police officers are alleging that the defendant admitted to all of the sexual activity reported by the student.
Yessenia Garcia was booked into the Santa Ana Jail, and her bail was set at $100,000. Detectives believe that there could be other victims.
Liability For Santa Ana Teacher Sexual Abuse
Sexual abuse in a school setting remains all too common. It is critical that schools create clear codes of conduct in order to limit abuse. According to the U.S. Department of Justice, “Abusive actions are more likely to be detected and reported if a clear code of conduct for educators is known to both students and teachers and protections against false allegations are in place. Training programs for educators regarding the nature, seriousness, and effects of abuse can also help in preventing sexual abuse and harassment.” Schools should take a number of other actions in order to prevent sexual abuse.
- Schools should conduct thorough background checks on all teachers and school employees.
- Schools should enforce rules that prevent one-on-one unsupervised interactions between adults and students.
- Schools should engage in regular audits so that they can periodically review and update safety policies.
Schools have a legal obligation to adequately supervise students at all times of the day and protect them from reasonably foreseeable sources of harm. Consider, for example, C.A. v. William S. Hart Union High School District. The California Supreme Court held that a school could be liable for instances of sexual abuse, even if the abuse took place off of school grounds. This may be the case if the school’s negligent hiring, supervision, or retention of an employee contributed to the abuse. It is important that certain steps are taken after any instance of sexual abuse involving a school teacher.
- A police report should be created.
- Evidence of the teacher’s misconduct should be preserved, including text messages.
- An experienced teacher sexual abuse attorney should be contacted.
Teacher sexual abuse is often highly preventable. One of the main problems is that schools fail to implement protocols designed to prevent abuse, including procedures to report misconduct. By the time any school employee is being charged with sexual abuse, there are often numerous red flags that are missed. But schools will rarely admit that they made mistakes. This is why it is important for victims of misconduct to seek legal advice as early as possible.
