Liability For Los Angeles County Child Sexual Abuse
Sexual abuse in sports is much more common than many people may realize. According to a new report by the Guardian, “in some cases, coaches and instructors have exploited children’s vulnerabilities and the physical contact sport enables in order to groom and abuse them.” All of the perpetrators in the Independent Inquiry into Child Sexual Abuse study were male. Sports clubs were the most common location for the abuse. Sexual harassment and abuse can take many different forms.
- Unwanted touching or kissing
- Requests for sexual favors
- Using sexually explicit language
- Rape
It is common for schools to hire independent coaches in various fields from soccer to gymnastics. If a child is sexually abused by a coach, the school that they may have worked for could be held liable. Schools must properly supervise the children in their care to protect them from abuse. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” There are a number of steps that should be taken after any instance of sexual abuse.
- A police report should be made.
- Surveillance footage should be sought.
- An experienced child sexual abuse attorney should be consulted.
Much of the child sexual abuse that takes place could have been prevented if it were reported earlier. Sadly, it is common for teachers and school faculty to turn a blind eye towards abuse taking place in their midst. Any person that is the victim of child sexual abuse may be able to seek some level of justice through a civil claim. California has recently passed a law extending the statute of limitations for child sexual abuse. A child sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
