Liability For Fontana Police Shootings
Thousands of people are shot and killed each year in the United States. A police shooting can take place for a variety of different reasons. But a disproportionate number of fatal police shootings involve suspects in the midst of a mental health crisis. According to the Treatment Advocacy Center, “People with untreated mental illness are 16 times more likely to be killed during a police encounter than other civilians approached or stopped by law enforcement.” Police departments are often poorly equipped to deal with suspects who need mental health services. There are many signs that a suspect is suffering from a mental health crisis.
- A suspect might have disorganized or incoherent speech.
- A suspect might demonstrate erratic or unusual behavior.
- A suspect might show signs of severe emotional distress.
- A suspect may experience delusions or hallucinations.
- A suspect may appear to be disoriented or highly confused.
Police officers are supposed to always use the least amount of force feasible to get suspects to comply with their demands. If a police officer uses excessive force, this could form the basis of a constitutional claim. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. The circumstances of any police shooting should be well understood.
- Body camera footage from all officers involved should be examined.
- Surveillance footage of the incident should be sought.
- Medical records for the deceased should be reviewed.
- The actions of police officers leading up to the shooting should be known.
Police departments have protocols that they are supposed to follow if they encounter a suspect under the influence or going through a mental health crisis. But far too often, these protocols are ignored. The family of any person that died in a police shooting may have legal recourse through a constitutional claim. A civil rights attorney can examine all of the unique facts of your case and let you know what your legal options are.
