Liability for Riverside County Child Sexual Abuse
Child sexual abuse remains alarmingly common in the United States. According to the National Institutes of Health, “The prevalence of child sexual abuse was 10.14% (24.8% in men, and 75.2% in women). Child physical abuse, maltreatment, and neglect was more prevalent among individuals with CSA than among those without it.” There are a number of measures that daycares should take in order to prevent child sexual abuse.
- Daycares must follow all laws and regulations necessary for childcare.
- All employees of a daycare should be properly vetted.
- Daycare employees should never be left alone with individual children.
Daycares have a legal obligation to protect children from reasonably foreseeable sources of harm. Pursuant to California Civil Code 1714, a property owner could be liable for any instance where a person is injured on their property due to the lack of ordinary care in managing their property. If a property owner knew (or should have known) that an employee posed a risk of harm to children and failed to act, this could form the basis of a negligence claim. It is important that certain steps are taken after any instance of sexual abuse in a daycare setting.
- A police report of the incident should be created.
- Surveillance footage should be sought.
- Medical records related to the incident should be collected.
- An experienced personal injury attorney should be contacted.
One of the issues with daycares is that many are unlicensed. These often take place in a family home setting. Even if the employees / owners of these at home daycares pass criminal background checks, there may be people living at the home that pose a danger to children. It is important that victims of child sexual abuse and their parents understand that they do have legal rights. They are able to seek some measures of accountability through a civil claim.
