Liability for Coachella Valley Unified School District Sexual Abuse

California has one of the highest instances of teacher sexual abuse in the United States. This has traumatized generations of students and resulted in numerous lawsuits. According to Redlands Daily Facts, “from Los Angeles to Redlands and Riverside to Torrance, victims of sexual abuse are settling lawsuits with school districts that failed their students, costing taxpayers more than $313 million in the past seven years.” A major part of the problem is that numerous school districts have engaged in a long pattern of covering up sexual abuse allegations. There are a number of measures that schools should take in order to prevent sexual abuse.

  • All school employees should undergo a thorough background check.
  • Schools should have reporting mechanisms to identify sexual abuse.
  • Teachers should not be allowed to remain isolated with individual students.
  • School districts should enforce a zero-tolerance policy for sexual misconduct.

Schools have a legal obligation to protect all of the students in their care from foreseeable sources of harm. This includes protecting them from sexual abuse at the hands of teachers and other students. Consider, for example, C.A. v. William S. Hart Union High School District. A minor sued a public high school and the school district after being sexually abused by a guidance counselor. The Supreme Court of California held that the school could be vicariously liable for sexual abuse if it was caused by its negligent hiring, retention, or supervision of its employee. It is important that certain steps are taken after any instance of school sexual abuse.

  • A police report of the incident should be created.
  • Medical records related to the abuse should be preserved.
  • The school’s knowledge of the perpetrators actions and past behavior should be understood.
  • An experienced teacher sexual abuse attorney should be contacted.

Sexual abuse in a school setting is often highly preventable. It tends to be the result of school administrators that fail to adequately supervise children and enforce all rules necessary for their protection. By the time any teacher is arrested for sexual abuse, there are often numerous red flags that are missed. Victims of sexual abuse should understand that they do have legal rights. They are able to seek some measure of accountability and justice through a civil claim.
