Liability for Moreno Valley Police Shootings
Police officers have a legal obligation to use reasonable levels of force when executing their job duties. The legality of any police shooting in California will be evaluated under federal constitutional standards as well as California’s laws governing the use of police force. The United States Supreme Court held in Graham v. Connor, 490 U.S. 386 (1989) that instances of police force must be objectively reasonable under the totality of circumstances that an officer encountered at the scene. Multiple factors will be taken into consideration when evaluating a police shooting.
- Immediate Threat: It matters whether or not the suspect of any case posed an immediate threat to officers or those in the vicinity.
- Weapon: The nature of any weapon involved in the encounter and the distance between all parties should be taken into consideration.
- Warnings: Investigators will take into consideration whether or not officers involved issued warnings and attempted to de-escalate the encounter.
- Mental Health: Another important consideration is whether or not officers followed police protocols related to dealing with any person who may be in the midst of a mental health crisis.
When a police officer uses excessive force and seriously injures or kills a suspect, this could form the basis of a constitutional claim. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution, shall be liable to the injured party in an action at law. In particular, a court could find that an officer behaved inappropriately if they did not follow their own department safety protocols for any person in serious mental distress.
Evidence and Accountability for Excessive Force by Police Officers
Police use of force remains an important safety and accountability issue in the state of California. According to one report by the California Department of Justice, there were 619 incidents of serious bodily injury or death involving police use of a firearm in 2025 alone. It is vital that all of the evidence related to these encounters is properly preserved and evaluated.
- Body camera footage from responding officers should be requested and reviewed.
- The communication between police officers and dispatch should also be taken into consideration.
- Notes of any communication involving mental health professionals are another important piece of evidence.
- Police department policies and training materials related to de-escalation and use of force can play an important role in civil litigation.
Many instances of police force are totally preventable. They tend to involve situations where officers are either unwilling or unable to de-escalate encounters. Unfortunately, police departments are not likely to admit fault when one of their officers seriously injures or kills a suspect. This is why it’s so important that these incidents are investigated by an outside party. Any person injured in a police shooting may be able to seek some measure of accountability through a civil claim.
