Liability For Ventura County Police Shootings
A disproportionate number of police shootings involve people going through a mental health crisis. According to the Treatment Advocacy Center, “The risk of being killed while being approached or stopped by law enforcement in the community is 16 times higher for individuals with untreated serious mental illness than for other civilians.” There are a number of steps that the police department should take in order to avoid injuring suspects.
- All police officers should be trained in de-escalation techniques and crisis management.
- Police officers should have less-lethal options available, such as tasers.
- Police departments should have clear use of force policies.
- Police departments should be transparent about use-of-force encounters.
Police departments can be held accountable for any instance of excessive force. According to 42 U.S. Code § 1983, every person who, under the color of law, deprives someone of their rights afforded under the Constitution shall be liable to the injured party in an action at law. It is important that certain steps are taken after any police shooting.
- Eyewitnesses should be interviewed.
- Body camera footage should be collected.
- Medical records should be reviewed.
- An experienced civil rights attorney should be contacted.
There are specific policies and procedures that police officers should follow if they believe that a suspect may be in the midst of a mental health crisis. When a police officer fails to follow a safety rule from their employer, this could serve as evidence of negligence. It is important that victims of excessive force understand that they do have rights. They are able to seek some measure of justice through a civil claim.
