Liability For Los Angeles County Sexual Abuse
Sexual abuse involving school teachers remains all too common across Los Angeles. According to Morningstar, “The Los Angeles Unified School District (LAUSD) and former teacher Mark Berndt are being named in a civil complaint alleging that at least 25 individuals were sexually assaulted as children by Berndt during his tenure at Miramonte Elementary School.” The Carrillo Law Firm has represented numerous victims of sexual abuse at Miramonte Elementary School. Numerous factors may contribute to sexual abuse in a school setting.
- Sexual abuse is more likely to take place when school officials are not properly vetted with background checks.
- Sexual abuse is more likely when students are not being properly monitored.
- Sexual abuse is more likely when schools fail to investigate allegations of misconduct.
All schools have a legal obligation to protect students from reasonably foreseeable sources of harm. This includes protecting students from sexual abuse. School officials must adequately supervise students at all times of the day. They must also enforce all rules and regulations necessary to their protection. When a school fails to protect children from sexual abuse, this could form the basis of a negligence claim. It is important that certain steps are taken after any instance of school sexual abuse.
- Eyewitnesses should be interviewed.
- School records related to the incident should be preserved.
- An experienced sexual abuse attorney should be contacted.
Sexual abuse in a school setting is highly preventable when schools are following safety guidelines. Among other things, school officials need to understand that certain groups are more vulnerable than others. Much of the sexual abuse in a school setting involves young girls. Students with learning disabilities are particularly at risk. Any person that is sexually abused by a school teacher may be able to seek some measure of justice through a civil claim.
