Liability For Los Angeles County Student Sexual Abuse
Sexual abuse is much more prevalent than many parents may realize. According to RAINN, “One in 9 girls and 1 in 20 boys under the age of 18 experience sexual abuse or assault. 82% of all victims under 18 are female. Females ages 16-19 are 4 times more likely than the general population to be victims of rape, attempted rape, or sexual assault.” Victims of sexual abuse are more likely to experience a variety of mental health challenges.
- Survivors are more likely to abuse drugs.
- Survivors are more likely to experience PTSD as adults.
- Survivors are more likely to experience a major depressive episode as adults.
Schools have a legal obligation to protect students from reasonably foreseeable sources of harm. This includes protecting students from sexual abuse. Consider, for example, Taylor v. Oakland Scavenger Co., 17 Cal. 2d 594 [110 P.2d 1044], “It is the duty of the school authorities to supervise at all times the conduct of the children on the school grounds and to enforce those rules and regulations necessary to their protection.” Schools should take a number of measures in order to protect students.
- Schools should develop and enforce codes of conduct.
- Schools should perform background checks on all employees.
- Schools should understand the warning signs that sexual abuse is taking place.
Sexual abuse is often highly preventable in a school setting. Indeed, by the time any school employee is arrested for misconduct, there are likely numerous red flags that were missed. It is also common for there to be multiple victims. Any person that is sexually abused by a school employee may have legal recourse through a civil claim. A sexual abuse attorney can examine all of the unique facts of your case and let you know what your options are.
