Liability for Sexual Abuse Involving Physicians
Sexual violence involving physicians is unfortunately all too common. According to the Journal of General Internal Medicine, “A 1998 study identified 567 U.S. physicians who were disciplined by state medical boards from 1981 through 1996 for sex-related offenses (including sexual intercourse, rape, sexual molestation, and sexual favors for drugs), 75% of which involved patients.” There are a number of factors that may contribute to Dr. sexual abuse.
- Male physicians are more likely to commit sexual abuse.
- Abusers tend to be over the age of 39.
- Abusers typically worked in non-academic settings.
- In the vast majority of cases, abusers examined patients alone.
Hospitals have a legal obligation to protect patients from foreseeable sources of harm. Sexual abuse in a medical setting is a known danger. Hospitals must properly supervise physicians and all medical staff. They must also ensure that everyone around patients and in a medical setting undergoes a thorough background check. If a hospital knew or should have known that a physician posed a risk of harm to a patient and failed to act, this could form the basis of a civil claim. It is important that certain steps are taken after any suspected instance of physician sexual abuse.
- A police report of the incident should be created.
- Medical records related to the incident should be sought.
- The extent of the sexual misconduct should be understood.
- An experienced sexual abuse attorney should be contacted.
Patients trust doctors with their own lives in many instances. It can be absolutely devastating to have this trust betrayed through sexual abuse. These crimes are often the most traumatic and difficult events for most people to go through. Survivors may suffer a wide range of negative health outcomes. They are much more likely to develop post-traumatic stress disorder, anxiety, depression, and other psychological ailments. Any person that is sexually abused by a physician may be able to seek some measure of accountability through a civil claim.
