Avila v. City of Pomona – $1,300,000.00

In this police excessive use of force case, the Carrillo Law Firm represented the family of Andres “Andy” Avila, who had been shot and killed by Pomona police on the morning of October 16, 2011. Prior to that officer involved shooting, Mr. Avila had been beaten and tased by the City of Pomona police officers during a 4th of July party that summer. On the morning of October 16, 2011, Pomona police officers came upon a car in which Andy was sleeping in with a female companion. After some questioning by the officers, and while asking him to step out of the car, officers yelled “he’s got a knife” or “knife” and after an officer tased him, he was then shot multiple times by a City of Pomona police officer killing him instantly. The entire incident was captured on video.

The Carrillo Law Firm filed the federal civil rights lawsuit against the City of Pomona for the excessive and deadly unjustified shooting of Mr. Avila. Due to the efforts of the Carrillo Law Firm, the firm was able to secure a settlement in the amount of $1.3 million for the family of the deceased. Although no amount of money will bring a child back, the family was able to secure some form of justice for the wrongful shooting of their son.
